You did the work. You finished the job. So what happens when the payment still hasn’t come?

Louisiana law provides important protections for contractors, subcontractors, and suppliers working on qualifying private construction projects.

Under La. R.S. 9:2784, owners generally have 35 days after receiving a written request for payment to pay a contractor for qualifying work. Once the contractor receives payment, they generally have 7 days to pay the subcontractors and suppliers whose work was included in that payment.

And there can be consequences for failing to pay. When payment is withheld without a good-faith dispute, the law may provide for a 1.5% per month penalty, as well as a legal action to collect amounts owed. The prevailing party may also be entitled to reasonable attorney’s fees and court costs.
